A Win for Short-Term Rental Owners

In a victory for real estate investors in Colorado Springs, a client of the Kanthaka Group obtained a unanimous vote approving their appeal in front of the Planning Commission. This appeal allowed our client to continue renting out units of a home under non-owner-occupied short-term rentals (STR). 

The City of Colorado Springs recently discovered an issue in which a property was within 500 feet of another non-owner-occupied short-term rental. Originally, these STR permits were granted in 2021 but when seeking renewal in 2022, they were denied based on the fact they were within 500 feet of the other short-term rental.

Sullivan Manion of the Kanthaka Group asserted that our client had already been in possession of the permits creating a property interest. Without these STR permits, the client would lose tens of thousands of dollars a year in rental income, and the property was in substantial compliance with all zoning and PlanCOS requirements.

The Planning Commission agreed and upheld the appeal in a unanimous vote, granting two non-owner-occupied short-term rentals where the client had originally only had one.
