Colorado Issues Guidance to Insurers

The Colorado Insurance Division has issued guidance to insurance companies on how to adjudicate the claims of policyholders affected by the Marshall and Middle Fork Fires.  

The material in the bulletin is important for every affected homeowner to know.  The Bulletin in Part III has five items of specific guidance to insurers.  The timing of the fire, just before the onset of winter storms, has resulted in some specific guidance to follow as it is likely additional damage to their properties may occur, due to the inclement weather.  

Homeowners should be aware of the Division’s position on these issues when negotiating and interacting with their insurer, and it is possible that the insurer will act in bad faith, regarding this guidance, as it extends their liability.
